Introduction

Welcome to Persica Studio. These Terms and Conditions govern your relationship with Persica Studio ("we," "our," or "us") and your use of our facilities, services, and equipment. By registering with us, entering our premises, or using our services, you agree to these Terms and Conditions in their entirety.

Please read these Terms carefully. If you do not agree with any part of these Terms, you may not use our services or facilities. We may update these Terms from time to time, and your continued use of our services constitutes acceptance of any changes.

1. Definitions

In these Terms, the following definitions apply:

• "Model" refers to any individual who uses our facilities and services for content creation.
• "Studio" refers to Persica Studio, its premises, facilities, equipment, and services.
• "Content" refers to any material created by Models while using our facilities, including but not limited to videos, photos, streams, or other digital media.
• "Platform" refers to any third-party website or service where Models broadcast or upload their Content.

2. Model Eligibility

To use our facilities and services, Models must:

• Be at least 18 years of age.
• Provide valid government-issued photo identification.
• Complete and sign our registration documents.
• Comply with all applicable laws and regulations.
• Meet any additional requirements specified by management.

We reserve the right to refuse service to anyone at our discretion, particularly if we believe they may not meet these requirements or may pose a risk to our community.

3. Studio Facilities and Services

3.1 Facilities

The Studio provides various facilities for Models, including private rooms, equipment, internet connectivity, and common areas. All facilities are subject to availability and may be reserved in advance according to our scheduling policies.

3.2 Equipment

We provide professional equipment for content creation. Models are responsible for using equipment properly and reporting any malfunctions or damage immediately. Models will be financially responsible for any damage caused by negligence or misuse.

3.3 Technical Support

Technical support is available during operating hours. While we strive to resolve technical issues promptly, we cannot guarantee uninterrupted service or immediate resolution of all technical problems.

3.4 Training

We offer training sessions for new Models. Participation in initial training is mandatory. Additional training may be required periodically to maintain quality standards.

4. Scheduling and Room Usage

Models may reserve rooms according to our scheduling system. We reserve the right to modify schedules as necessary. Repeated late arrivals or no-shows may result in scheduling restrictions or termination of our relationship.

Models must leave rooms in the same condition as they found them. Any personal items brought into the rooms must be removed at the end of each session. The Studio is not responsible for lost, damaged, or stolen personal items.

5. Compensation and Payments

Compensation details are outlined in separate agreements with each Model. Payment schedules, methods, and any applicable fees will be specified in these agreements.

Models are responsible for complying with all tax laws and regulations applicable to their income. The Studio provides required tax documentation but does not offer tax advice.

6. Code of Conduct

Models must adhere to our Code of Conduct, which includes:

• Treating all Studio staff and other Models with respect and professionalism.
• Maintaining appropriate hygiene and appearance while in the Studio.
• Following all safety protocols and emergency procedures.
• Refraining from bringing unauthorized guests into the Studio.
• Not consuming alcohol or illegal substances on Studio premises.
• Complying with all rules and regulations posted in the Studio.

Violation of the Code of Conduct may result in immediate removal from the premises and termination of our relationship.

7. Content Standards

Models are responsible for ensuring their Content complies with all applicable laws and platform policies. The Studio prohibits the creation of Content that:

• Involves minors or individuals under the age of 18.
• Depicts or promotes illegal activities.
• Contains hate speech or promotes discrimination.
• Infringes on third-party intellectual property rights.
• Violates any laws, regulations, or platform policies.

The Studio reserves the right to monitor Content creation to ensure compliance with these standards. Violation may result in immediate termination of our relationship and potential legal action.

8. Confidentiality

Models agree to maintain confidentiality regarding:

• Personal information of other Models or Studio staff.
• Studio business practices, operations, and proprietary information.
• Technical setups, security measures, and other sensitive information.
• Any information designated as confidential by the Studio.

This confidentiality obligation continues even after the termination of your relationship with the Studio.

9. Intellectual Property

Models retain ownership of their Content subject to the terms of their agreements with platforms and any specific agreements with the Studio. Models grant the Studio limited rights to use their name, likeness, and Content for promotional purposes, as specified in separate agreements.

The Studio's name, logo, website, and other materials are protected by intellectual property laws. Models may not use these without explicit written permission.

10. Privacy

The Studio collects and processes personal information in accordance with our Privacy Policy. By agreeing to these Terms, Models also consent to our collection and use of their personal information as described in the Privacy Policy.

Models must respect the privacy of other Models and Studio staff. Unauthorized recording or photography of others in the Studio is strictly prohibited.

11. Termination

Either party may terminate the relationship with notice as specified in individual agreements. The Studio reserves the right to terminate immediately for violations of these Terms, the Code of Conduct, or applicable laws.

Upon termination, Models must:

• Return all Studio property and equipment.
• Settle any outstanding financial obligations.
• Remove all personal belongings from the premises.

Certain provisions of these Terms, including those relating to confidentiality, intellectual property, and liability, survive termination.

12. Liability and Indemnification

The Studio strives to provide a safe environment but is not liable for:

• Personal injury unless caused by our negligence.
• Lost income due to technical failures or service interruptions.
• Actions of other Models or third parties.
• Loss or damage to personal property.

Models agree to indemnify and hold harmless the Studio from any claims, damages, or liabilities arising from their Content, their violation of these Terms, or their violation of any rights of another person or entity.

13. Dispute Resolution

Any disputes arising from these Terms or the relationship between Models and the Studio will be resolved first through informal negotiation. If a resolution cannot be reached, the dispute will be submitted to mediation before any legal action is taken.

These Terms are governed by the laws of Romania, without regard to its conflict of law provisions. Any legal proceedings will be brought exclusively in the courts of Romania.
